1. Through the instant petition filed under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023, prayer is for grant of anticipatory bail to the petitioner in case bearing FIR No.0211 dated 13.12.2022 registered under Section 379 of Indian Penal Code, 1860 (for short ‘IPC’) and Section 21 of Mines and Mineral (Development and Regulation) Act, 1957 (Sections 353, 186 & 506 of IPC added vide DDR No.043 dated 02.01.2023) at Police Station Makhu, District Ferozepur.

2. Briefly stated, upon receiving secret information to the effect that illegal mining is being carried out on panchayat land of village Khandoor and sand was being loaded into the trolleys for transportation, the mining officer went at the spot for checking. The petitioner was found present at the spot, and on inquiry, he intentionally disclosed his wrong identity by disclosing his name as ‘R
