1. This order shall dispose of afore-mentioned two petitions seeking bail pending trial in case arising out of common FIR No.11 dated 30.01.2025, registered under Sections 111(3), 113 (Section 109, 3(5) added later on) of BNS, 2023 and Sections 25(6) and 25(7) of the Arms Act, 1959 and Sections 3, 4, 5 & 6 of Explosive Substances Act, 1908, at Police Station Sirhali, District Tarn Taran.

Facts in brief are that on 30.01.2025, the Investigating Officer received a secret information to the effect that the accused, namely, Jasdeep Singh alias Jass, Robinjeet Singh alias Robin, Yuvraj Singh alias Jaggu, Karan Singh alias Kala, Harpreet Singh alias Happy, Ajay alias Tunda, Navjot Singh alias Nav, Gurdev Singh alias Jaissal, Satbir Singh alias Satnam Singh alias Satta and Sahib Singh alias Saba, had formed a gang, and started demanding ransom from traders and wealthy persons in the State of Punjab by issuing threats, intimidation tactics and firing at homes. They were carrying out organized crimes, including robbery, extortion, murder and other violent acts using weapons. They also used to organize other crimes at the gunpoint with their associates Gurdev Singh alias Jaissal, Satbir Singh alias Satta and Sahib Singh alias Saba, who are abroad and by contacting their associates, through Virtual Numbers from abroad and ordered arms and Explosive substances from Pakistan and the information was solid and trustworthy. On the basis of said information, the present FIR No.11 dated 30.01.2025, under Section 111(3)/113 of BNS & 25(6)(7) of the Arms Act & 3/4/5/6 of the Explosive Substances Act was registered at Police Station Sirhali, District Tarn Taran against the accused, namely, Jasdeep Singh alias Jass, Robinjeet Singh alias Robin, Yuvraj Singh, Karan Singh, Harpreet Singh alias Happy, Ajay alias Tunda, Navjot Singh alias Nav, Gurdev Singh alias Jaissal, Satbir Singh alias Satnam Singh and Sahib Singh alias Saba.

Learned counsel appearing on behalf of the petitioners contend that petitioner-Gurpreet Singh was arrested in the present case on 23.05.2025 while Gurpreet Singh @ Karan Singh @ Karan @ Doctor Karan son of Gurjant Singh (petitioner in CRM-M-3602-2026) was arrested on 04.02.2025. They further contend that petitioners have no criminal antecedents and no recovery has been effected from Gurpreet Singh @ Karan Singh son of Gurjant Singh, while one pistol has been recovered from Gurpreet Singh son of Jagjit Singh. Learned counsel further contend that all other co-accused have been granted the concession of regular bail, including co-accused Harpreet Singh @ Happy from whom grenades had been recovered. They further contend that police investigation has not revealed that any extortion threat was received by any person or that any amount was paid to either of the petitioners at any point of time. They also contend that investigation has been completed and there are 40 prosecution witnesses but none has been examined so far. Even the charges are yet to be framed so conclusion of trial will take a sufficiently long time.

Counsel for the petitioners referred to various orders passed by the Coordinate Benches whereby co-accused have been granted regular bail vide orders dated 11.07.2025, 24.07.2025, 28.10.2025 and 22.12.2025 passed in CRM-M-34817-2025, CRM-M-38143-2025, CRM-M-42913- 2025 and CRM-M-46073-2025, respectively.
