1. The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:-

2. Complainant-Rajesh alias Dholu got registered FIR and the allegations reads as under:

“I, Rajesh @ Dholu S/o Jaikishan, a R/o Mirpur, and my brother Surendra have 35-35 acres of land in Mirpur. Neelam, a R/o Raipur, is married to Raju Janges, a R/o Mirpur. They have two sons. Neelam and Raju are at odds with each other, and she lives in Raipur with her children. Being of my caste, I have been helping her financially, Four or five years ago. I had an altercation with Dariya Singh Bhadiya, a R/o Mirpur. At that time, his son Jagdish Bhadiya was in jail Now he is out. Sanjay Khati (Neelam's cousin), a R/o Raipur, from Neelam's family, came to know about is altercation. About 15 days ago, he called me and said that Jagdeep Blodiya would take revenge on me and kill me. Sanjay, a R/o Raipur, got scared by this statement and told me that Jagdeep Bhadiya would kill me. He came to Mirpur and told me that he would arrange for my security, and be introduced me to a boy named Dholu Chaudhary in Sector 14, Hisar, and said that we have many boys and we will provide them with weapons and ensure your security. On the same day, he took two lakh rupees from me in the name of security, and two days later, he took nine lakh eighty thousand rupees from me in Agroha, which I withdrew from HDFC Bank, Agroha. Then he sent five of his known boys to me, and at that time, I had Sandeep Chhachhiya's Scorpio car. My driver Potu @ Kuldeep was also with me. These five boys sat in my car, and I kept roaming around in Hisar, Rajasthan, Gogamedi, and other places for two days. During this, a boy named Rohit, who was an acquaintance of theirs sitting in the car, received a call from Sanjay, R/o Raipur, and he made me talk to Sanjay. Sanjay told me that we have to buy more weapons and a bulletproof jacket for you. He asked for six and a half lakh rupees. I gave one and a half lakh rupees to Bhartha Jankhar and two lakh rupees to Ved Madan, and got Sanjay three lakh rupees from Hanuman Godara. Two days after that, he sent a boy named Rohit to me, and after scaring me, Rohit took away eleven lakh rupees. On 25.02.2025, a boy named Gholu Chaudhary came to my house with his six other boys, and he had two revolvers and two pistols. Two of them stayed at my house at night, named Rohit and one named Robil. They did not let me talk to anyone. During the day, they took me to a field and said that they were practicing shooting, and they fired a few bullets there. During this, Chotal @ Naseeb, R/o Mirpur, was also with us. When night fell, they took me with them to my house and started demanding money. I said that I do not have any more money right now, you should go away from here, I do not need any security. They beat me up and held me hostage and started showing me a revolver and pistol. Out of fear, I spoke to my acquaintances and got two lakh rupees from Pontu, who is my driver. I got four and a half lakh rupees from Golar @ Surendra. I took out two lakh seventy thousand rupees from my house. After that, they came to know that a complaint had been lodged with the police.
