1. CWP-4154-2001 has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of certiorari seeking quashing of criteria laid down by respondent No.1 for promotion from MMGS- I to MMGS-II and also the order dated 02.12.1999 (Annexure P-4), vide which respondents No.2 to 11 were promoted. It is further prayed to issue a writ in the nature of mandamus directing respondent No.1 to consider the cases for promotion of all eligible persons as per old promotion policy of 1988.

2. CWP-15471-1999 has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of certiorari to quash the seniority list dated 04.10.1999, vide which the private respondents were declared senior to the petitioners and further to direct the respondents to grant all the consequential benefits.

3. Learned counsel for the parties are ad idem that in view of the judgment rendered by the Hon’ble Supreme Court in Government of West Bengal and others Vs. Dr. Amal Satpathi and others, 2024 SCC Online SC

3512, the issue of promotion post-retirement cannot be considered and submit that both these petitions may be disposed of having been rendered as infructuous.

4. Ordered accordingly.

5. The pending miscellaneous application(s), if any, shall stand disposed of.
