NIDHI GUPTA J. (Oral)

The present appeal has been filed by the claimants seeking enhancement of compensation of Rs.21,43,000/- awarded by the learned Motor Accident Claims Tribunal, Sonipat, vide Award dated 19.09.2024, on account of death of Satish in a road-side accident.

On 15.01.2026, this Court, taking note of the submission made by learned counsel for the appellants that the matter had earlier been referred to the Daily Lok Adalat and that the respondent- Insurance Company had offered a sum of Rs.3,00,000/- over and above the awarded amount, referred the matter to the Permanent Lok Adalat for exploring the possibility of an amicable settlement between the parties. It was further directed that the matter be listed before this Court after receipt of the recommendations of the Permanent Lok Adalat.

Pursuant thereto, the matter was taken up before the learned Daily Lok Adalat on 22.01.2026, where, on the basis of statements made by the representatives of the Insurance Company and learned counsel for the appellants, an amicable settlement was arrived at between the parties. As per the said settlement, an additional sum of Rs.3,00,000/- (Rupees Three Lakh only), over and above the compensation already awarded by the learned Tribunal, has been agreed to be paid to the appellants in full and final settlement of the claim in the present appeal. It was further recorded that the enhanced amount shall be payable to appellant No.1-Mamta.

The learned Daily Lok Adalat, while disposing of the matter, directed the respondent-Insurance Company to deposit a crossed cheque in the sum of Rs.3,00,000/- in the name of appellant No.1-Mamta with the office of the Lok Adalat of this Court on or before 12.03.2026, failing which the said amount shall carry interest @ 9% per annum from the date of the order till its deposit. The application seeking condonation of delay of 39 days in filing the appeal was also disposed of in view of the settlement arrived at between the parties.

In view of the aforesaid settlement arrived at between the parties before the learned Daily Lok Adalat and the recommendations received therefrom, this Court finds no impediment in accepting the same. The settlement appears to be lawful, voluntary and arrived at with the consent of the parties, and thus deserves to be given effect to.

Accordingly, the present appeal is disposed of in terms of the settlement dated 22.01.2026 arrived at before the learned Daily Lok Adalat. The Award dated 19.09.2024 passed by the learned Motor Accident Claims Tribunal, Sonipat, shall stand modified to the extent that the appellants shall be entitled to an enhanced compensation of Rs.3,00,000/- (Rupees Three Lakh only), over and above the amount already awarded. The said enhanced amount shall be payable to appellant No.1-Mamta, in terms of the settlement.

The respondent-Insurance Company shall comply with the directions issued by the learned Daily Lok Adalat regarding deposit of the aforesaid amount, along with interest in case of default, strictly within the stipulated time, if not already complied with.

Since the matter stands settled amicably, no further adjudication is required.

Pending applications, if any, shall also stand disposed of.
