This application for bail under Section 439 Cr.P.C. (483 BNSS) has been filed by the petitioner who has been arrested in connection with F.I.R. No.36/2024, registered at Police Station Mukta Prasad Nagar, District Bikaner, for offences under Sections 3/25 (1-B)(a) and 5/25 of Arms Act.

Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioner submitted that the co- accused Vishnu Banguda from whose conscious possession one country-made pistol without proper license was recovered has already been enlarged on bail by the competent criminal Court vide order dated 24.01.2024.

Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 21.07.2024; the investigation against him has already been concluded; the challan has already been filed by the Investigating Agency before the competent criminal Court; and the trial of the case will take sufficiently long time, therefore, the benefit of bail should be granted to the accused-petitioner.

Per contra, learned Public Prosecutor has vehemently opposed the bail application.
