Order

1. This application for bail under Section 439 Cr.P.C. (483 BNSS) has been filed by the petitioner who has been arrested in connection with F.I.R. No.462/2024, registered at Police Station Pratapnagar (Udaipur), District Udaipur, for offences under Sections 376(2)(n) and 384 of the IPC and under Section 67 of the Information Technology Act.

2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case. Learned counsel submitted that as per the prosecutrix, she came in contact with the present petitioner in the year 2019-20 through Instagram.

4. Drawing attention of the Court towards the FIR and the statements of the prosecutrix recorded under various Sections of Cr.P.C., learned counsel for the petitioner submitted that the prosecutrix out of her free will and volition, continued to remain in touch with the present petitioner and she also developed consensual physical relationship with the present petitioner.
