28/01/2025 This application for bail under Section 439 Cr.P.C. (483 BNSS) has been filed by the petitioner who has been arrested in connection with F.I.R. No.366/2021 registered at Police Station Sangaria, District Hanumangarh for offence under Section 376(2)
(n) of the IPC.
Learned counsel for the petitioner submitted that the prosecutrix- ‘L’, who is a mature married woman was having mutual relationship with the present petitioner. However, on turning relations between them turning sour/strained, the petitioner has been roped in a false criminal case.
Lastly, learned counsel for the petitioner submitted that the petitioner is in judicial custody and the trial of the case will take sufficiently long time, therefore, the benefit of bail should be granted to the accused-petitioner.
Per contra, learned Public Prosecutor has vehemently opposed the bail application.
Heard learned counsel for the parties at Bar. Perused the material available on record.
This Court looking, to the nature of allegations levelled against the present petitioner vide order dated 02.01.2025, directed the learned Public Prosecutor to call for the case diary.
