Order
An application (IA No.01/24) under Section 5 of the Limitation Act for condoning the delay in filing the criminal revision petition has been filed by the petitioner.
For the reasons and grounds mentioned in the application, the application is allowed.
Delay in filing criminal revision petition is, hereby, condoned. This revision petition has been filed against the judgment dated 03.02.2024 passed by the learned Special Judge SC/ST (Prevention of Atrocities) Cases, Udaipur in Criminal Appeal No.343/2023 by which, the appeal filed by the petitioner was dismissed and the judgment dated 03.06.2023 passed by the learned Special Judicial Magistrate (NI Act Cases) No.6, Udaipur in Crl. Regular Case No.1148/2018 convicting and sentencing the petitioner for offence under Section 138 N.I. Act has been affirmed. The petitioner was sentenced to undergo one year’s simple imprisonment along with fine in the sum of Rs.4,35,000/- in default of payment of fine, to further undergo one month S.I.
