This application for bail under Section 483 BNSS (Section
439 Cr.P.C.) has been filed by the petitioner who has been arrested in connection with F.I.R. No.0215/2024 registered at Police Station Bargaon, District Udaipur, for offences under Sections 419, 420 & 120-B of IPC and Sections 3 & 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.
Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submitted that the offences alleged to have been committed by the petitioner are triable by court of Magistrate. Learned counsel submitted that the petitioner is in judicial custody and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioner.
Per contra, learned Public Prosecutor has opposed the bail application.
