This application for bail under Section 439 Cr.P.C. (483 BNSS) has been filed by the petitioner who has been arrested in connection with F.I.R. No.202/2024 registered at Police Station Aburoad Sheher, Dist. Sirohi, for the offences under Sections 420 and 406 of IPC.
As per the prosecution, the petitioner along with two to three other persons came to the complainant’s jewelry shop in a black mahindra car bearing registration no.GJ-01-HB-9895. The petitioner and other persons took some gold/silver ornaments from the complainant’s shop and therefore showed him a fake screenshot of payment.
Learned counsel for the petitioner submitted that the offences alleged to have been committed by the petitioner are triable by Magistrate.
Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 18.09.2024; investigation against him has already been completed; no recoveries are due to be made from him; and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioner.
Per contra , learned Public Prosecutor has vehemently opposed the bail application.
