Order

1. This application for bail under Section 483 of BNSS has been filed by the petitioner who has been arrested in connection with F.I.R. No.268/2023 registered at Police Station Chitawa, District Deedwana- Kuchaman for offences under Sections 376(2)(n) & 384 of IPC .

2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner submitted that as per the prosecution, the prosecutrix was subjected to forcible sexual assault- rape on multiple occasions by the petitioner by threatening to make her obscene photographs and videos viral on social media platform about two years prior to the date of lodging of the FIR .

4. Learned counsel for the petitioner submitted that the prosecutrix is a mature married woman and no plausible explanation has been furnished by the prosecutrix for lodging the FIR after a delay of more than two years. Learned counsel further contended that as per prosecutrix, she was subjected to sexual assault- Rape on multiple occasions by the petitioner by threatening to make her obscene photographs and videos go viral, however, no obscene photographs and videos of the prosecut
