The matter comes up on an application (I.A. No.01/2024)
under Section 5 of the Limitation Act for condonation of delay in filing the present criminal revision petition.
For the reasons stated in the application, the application is allowed. Delay in filing the present criminal revision petition is hereby condoned.
The matter is being heard and decided today itself.
This revision petition has been filed against the judgment dated 27.03.2024 passed by the learned Special Judge, SC/ST (Prevention of Atrocities) Act Cases, Udaipur in Criminal Appeal No.370/2023, by which, the appeal filed by the petitioner was dismissed and the judgment dated 05.07.2023 passed by the learned Special Judicial Magistrate, (N.I. Act Cases) No.4, Udaipur in Criminal Regular Case No.553/2017 convicting and sentencing the petitioner for offence under Section 138 N.I. Act has been affirmed. The petitioner was sentenced to undergo one year’s simple imprisonment along with fine in the sum of Rs.6,00,000/-. In default of payment of fine, the petitioner was sentenced to undergo one month’s simple imprisonment.
