HIGH COURT OF RAJASTHAN
ARUN BHANSALI
DAKHU DEVI – Appellant
Versus
STATE OF RAJASTHAN – Respondent
CW/9257/2022
An opportunity of hearing is a fundamental principle of natural justice that must be provided before any adverse decision is made against a person.
Headnote:
EXCISE - DEMAND NOTICE - OPPORTUNITY OF HEARING - Petitioners aggrieved by demand notice issued without opportunity of hearing - Petitioners required to file response within ten days - Competent authority to decide response within three weeks - Demand not to be enforced till issue decided.
Fact of the Case:
Petitioners, holders of liquor licenses, challenged a demand notice issued by the Excise Department without providing them an opportunity to be heard. They claimed to have already made the required payments and that the demand was contrary to the Excise Policy.
Finding of the Court:
The court found that the demand notice was issued based on an audit objection without providing the petitioners an opportunity to be heard. The court held that the demand could not be sustained without such an opportunity.
Issues: Whether the demand notice was issued without providing the petitioners an opportunity to be heard.
Ratio Decidendi: The court relied on the principle of natural justice, which requires that before any adverse decision is made against a person, they must be given an opportunity to be heard.
Final Decision: The court directed the petitioners to file their response to the demand notice within ten days. The competent authority was directed to decide the response within three weeks, and the demand was not to be enforced until the issue was decided.
