This petition is for fair investigation of the FIR No.350/2022

registered with Police Station Jawahar Nagar Jaipur City (East),

District Jaipur City (East) for offences under Sections 323 and 341

IPC.

Learned counsel for the petitioner submits that accused

Devender is the husband of Smt. Rekha Chaudhary, who is posted

in State of Rajasthan as Additional District & Sessions Judge. In

the circumstance, the petitioner-complainant apprehends that

monitoring of investigation by the Magistrate would not bring

fruitful result as even today the Police is being influenced by the

Authority concerned.

Considering the facts of this case, it is directed that the

Superintendent of Police, Jaipur City shall ensure investigation of

the case by a DSP Rank Officer and the District Judge, Jaipur shall

monitor fair investigation of the case.

The petitioner may approach the Magistrate concerned to

exercise the power of monitoring of the investigation and the

Magistrate concerned shall apprise the process of this matter

fortnightly to the District Judge, Jaipur.

With the aforesaid, petition stands disposed of.
