The present misc. application has been filed for modification

in the order passed by this Court in S.B. Criminal Misc. Petition

No.1849/2023 dated 20.04.2023.

Learned counsel for the petitioner submits that due to a

typographical error, offence under Section 458 IPC could not be

mentioned, therefore, the trial Court proceeded further in the case

for offence under Section 458 IPC. Counsel further submits that

compromise has arrived between the parties for Section 458 IPC

also. In these circumstances, it is prayed that the offence under

Section 458 IPC against the petitioners may also be quashed and

set aside

Learned Public Prosecutor has opposed the prayer made by

learned counsel for the petitioners.

Learned counsel for the complainant concurs the fact of

compromise and submits that offence under Section 458 IPC

against the petitioners may also be quashed and set aside.

In view of the aforesaid submissions, the offence under

Section 458 IPC against the petitioners is also quashed and set

aside.

Accordingly, the present misc. application is allowed.
