Order

10/02/2023

These bail applications have been filed under Section 439

Station Bhiwadi, District Police Bhiwadi, District Alwar for the

offence(s) under Section 382 IPC.

(2 of 2)

[CRLMB-18291/2022]

Learned counsel for the petitioners submits that the

petitioners have been falsely implicated in this case. They are

behind the bars since 24.11.2022. The alleged offence is triable by

a Judicial Magistrate, First Class. After completion of investigation,

charge sheet has been filed against the petitioner and conclusion

of trial is likely to take long time, hence petitioners may be

enlarged on bail.

Learned Public Prosecutor as well as learned counsel for the

complainant have opposed the bail applications.

Considering the contentions put-forth by the counsel for the

petitioners and taking into account the facts and circumstances of

the case, without expressing any opinion on the merits of the

case, this court deems it just and proper to enlarge the petitioners

on bail.

Therefore, these bail applications are allowed and accused

petitioner (1) Aavesh S/o Shivji and (2) Ajay S/o Shri Banta

Singh are ordered to be released on bail provided each of them

furnishes a personal bond in the sum of Rs. 50,000/- with two

sureties of Rs.25,000/- each before the trial court, subject to its

satisfaction, with the stipulation that the petitioners shall appear

before that court on all subsequent dates of hearing and as and

when called upon to do so.

A copy of this order be placed in connected file.
