This criminal misc. petition under Section 482 Cr.P.C. has been filed for quashing the order dated 05.12.2023 passed by learned Additional Sessions Judge No.2, Bandikui, District Dausa (for brevity, “learned appellate Court”) in criminal appeal No.11/2020: Jitendra Singh and Others v/s State as also to allow the aforesaid appeal and acquit the petitioners/appellants (for brevity, “petitioners”) of the charge for offence under Section(s) 326/34 IPC.

The relevant facts in brief are that an FIR No.786/2007 dated 04.11.2007 came to be registered against the petitioners at Police Station Bandikui, District Dausa whereupon, after investigation, charge-sheet was filed against them. After trial, the Court of learned Chief Judicial Magistrate, Bandikui, District Dausa (for brevity, “learned trial Court”) convicted and sentenced them under Section(s) 323/34, 324/34, 325/34, 326/34 and 341/34.
