Order reserved on : 16/05/2025 Order pronounced on : 21/05/2025 This application for bail under Section 483 of BNSS (439 Cr.P.C.) has been filed by the petitioner who has been arrested in connection with F.I.R. No.291/2023, registered at Police Station Begun, District – Chittorgarh for offences under Sections 8/18 &
19 of the NDPS Act.
Heard learned counsel for the petitioner and the learned Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submitted that as per the case of the prosecution, on 28.10.2023, on secret information, the police party made a search of the house of Balkishan and found illegal narcotic contraband – opium Doda Powder weighting 139.820 kg in 10 Kattas and opium weighing 4.360 kg without a valid license, which were seized.
Learned counsel for the petitioner argued that accused-
petitioner has been falsely implicated in the present case. The recovery of narcotic contraband opium Doda powder and opium have been planted upon him. The petitioner has no concern with the seized opium Doda powder and opium. The house from where the illegal narcotic contraband alleged to have been recovered, does not belong to the petition
