23/05/2025 This application for bail under Section 483 of BNSS (439 Cr.P.C.) has been filed by the petitioners who have been arrested in connection with F.I.R. No.01/2025 registered at Police Station Myajlar, District Jaisalmer for offences under Sections 189(2), 115(2), 126(2), 324(4), 117(2) & 118(1) of the BNS.
Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioners submits that as per the prosecution story, the present petitioners along with other co- accused persons assaulted the complainant and his associates, inflicted serious injuries upon them, allegedly due to a prior enmity. Learned counsel further submits that the accused- petitioners have been falsely implicated in the present case. Learned counsel submits that as per the injury report the injury Nos.1 and 2 of Ratan Singh and injury No.2 of Hameer Singh are grievous in nature and rest all other injuries are simple in nature and the injuries are not on the vital part of the body. Learned counsel further submits that the petitioners are in custody since 16.02.2025 and the trial of the case will take sufficiently long time,
