For the Appellants/Petitioners:Mr. Vikas Balia, Sr. Advocate, Mr. Naresh Kumar
For the Respondents: Mr. U.R. Kalbi, P.P.
The court ruled that insufficient investigation into identity leads to granting bail in drug-related cases.
Headnote:(A) Narcotic Drugs and Psychotropic Substances Act, 1985 - Section 15 - Bail application concerning the FIR registered for alleged contravention of narcotics regulations. - Petitioner contended he was falsely implicated due to mistaken identity with another individual, supported by the investigation's lack of verifying identity and absence of prior criminal record. (Paras 2, 3, 4)
(B) Right to Bail - The court emphasizes the necessity of thorough investigation and verification of facts before basing arrests on mere disclosures from co-accused. (Paras 4, 5)
Facts of the case:
The petitioner was arrested on allegation of involvement in drug trafficking but argued he was misidentified by the investigation team and lacked any criminal history.
Findings of Court:
The court noted the inadequate investigation by authorities regarding the identity of the accused and favorably viewed the absence of a criminal record, concluding that the petitioner should be granted bail.
Issues: Determination of identity between petitioner and co-accused.
Ratio Decidendi: Court ruled that bail is warranted when the investigation is bereft of verification and implicates individuals based merely on co-accused disclosures.
Result: Bail application allowed.

He submits that the Investigating Officer – PW1 in his statement has stated that at the time of investigation he has not taken on record the call details and has also not investigated whether Rama and Ram Narayan are one and the same person and has also not investigated from the Village, Newa about the person Rama and neither any attestation has been taken from the Sarpanch or Gram Sewak. He does not dispute that no call detail records were obtained during the investigation, and no verification was carried out from the village Newa regarding the identity of the person named Rama. Further that no attestation or confirmation was sought from the local authorities such as the Sarpanch or Gram Sewak. Furthermore, the Public Prosecutor does not contest the statement of PW3 that the petitioner was implicated solely on the basis of the disclosure made by co-accused Rajkumar and the petitioner has no previous
