1. Instant appeals have been filed under Section 14A(2) of SC/ST (Prevention of Atrocities) Act, 1989 on behalf of appellants, who are in custody in connection with FIR No.08/2025 at Police Station Thanagazi, District Alwar for the offences under Sections 103(1), 238(a), 140(3), 127(3) & 61(2)(a) of BNS and Section

3(2)(v) of the SC/ST (Prevention of Atrocities) Act.

2. Learned Public Prosecutor submits that information to the complainant/victim has already been sent. However, no one has put in appearance on behalf of the complainant.

3. Heard heard learned counsel for appellants and learned Public Prosecutor and perused the material available on record.

Taking into consideration that appellants are not named in the FIR, FIR was registered on finding a dead body; after investigation, charge-sheet has been filed; as per charge-sheet, one Shubash Sharma was having illicit relations with deceased’s wife; Shubash Sharma has been held to be the main accused; appellants have been implicated on the basis of call details; there are no criminal antecedents of appellants; they are in custody since 20.01.2025, however, without commenting on merits of the case, this Court is of t
