1. The present writ petition has been filed challenging the impugned order dated 03.06.2025 (Annexure-9) passed by respondent no.2 whereby he has approved the recommendation made by the Executive Engineer for proposed action against the petitioner for the alleged violations.

2. The grievance of the petitioner is that the Executive Engineer i.e. respondent no.3 has received a report from the Assistant Engineer i.e. respondent no.4 regarding the alleged act of destruction of water channel and acting upon the report of the Assistant Engineer, the Executive Engineer has taken up the proceedings and came to the conclusion that the report found to be proved. Before passing the prohibition order debarring the petitioner from drawing the water, he sought approval of the Superintendent Engineer for the proposed action of debarring the petitioner for one year and penalty of 20% of the original water allowances. The Superintendent Engineer by virtue of the impugned order has approved the proposal made by the Executive Engineer in terms of Rule 10 of the Rajasthan Irrigation and Drainage Rules , 1955 (hereinafter referred to as the ‘Rules of 1955’).
