1. Applicant seeks condonation of delay of 498 days in filing the accompanied appeal. For the reasons stated hereinafter, this is not a fit case where discretion to condone the delay ought to be exercised.

That though while filing the instant appeal, unintentional and bonafide delay has occurred but the same has been occurred not only for the bonafide reasons but also spread of virus Covid-19 in all over the word and due to imposition of complete lockdown in the country and also hindered functioning of the courts in Rajasthan, the appellant was prevented by sufÏcient cause from filing the instant appeal within the period of limitation and as such, the unintentional and bonafide delay occurred in filing of the instant appeal is liable to be condoned in the interest of justice.
