Order

25/11/2025 The instant application for bail under Section 483 of BNSS (439 of Cr.P.C.) has been filed by the petitioners who have been arrested in the present matter. The requisite details of the matter are tabulated herein below:

S. No. Particulars of the case
1. FIR Number 105/2025
2. Police Station Jaswantpura
3. District Jalore
4. Offences alleged in the FIR Section 303(2) of BNS
5. Offences added, if any -

Learned counsel for the petitioners submitted that the offences alleged to have been committed by the petitioners are triable by court of Magistrate. It is further submitted that the petitioners have falsely been implicated in the present case. There is no specific evidence available on record to show involvement of the petitioners in the alleged incident. Learned counsel has also submitted that the petitioners have been in custody since 04.10.2025. The investigation and trial of the case will take sufficiently long time, therefore, benefit of bail may be granted to the accused-petitioners.

Per contra, learned Public Prosecutor has opposed the bail application and he submits that the petitioners have previous criminal record/antecedents of similar nature, therefore, benefit of bail may not be extended to the petitioners.

Having heard and considered the rival submissions, facts and circumstances of the case as well as perused the material available on record; the offences alleged to have been committed by the petitioners are triable by court of Magistrate; the petitioners have been in custody since 04.10.2025 and the trial of the case will take sufficiently long time; without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioners on bail.

Consequently, the bail application under Section 483 of BNSS (439 of Cr.P.C.) is allowed. It is ordered that the accused- petitioners as named in the cause title, arrested in connection with the above mentioned FIR, shall be released on bail, if not wanted in any other case, provided he/she/they furnish a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial court, for his/her/their appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.

In addition to the above, the petitioner is directed to appear before the concerned Police Station in the first week of every quarter of the year.

It is made clear that if the petitioner indulges in any similar kind of criminal activity, learned Public Prosecutor shall be free to file an application for cancellation of bail.
