Order
16/10/2025 In S.B. Criminal Miscellaneous Bail Application No. 12809/2025:-
1. The present interim bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No. 147/2023 - P.S. Gogamedi, Dist. Hanumangarh for the offence under Sections 363, 366, 376, 506 of IPC.
2. The instant application has been filed on the ground that the petitioner's mother is suffering from cist in uterus and her treatment is undergoing at Sub District Hospital, Nohar. The concerned doctor has advised for immediate surgery. There is no other member in the family to look after her, therefore, for the purpose of taking care of his mother, the temporary bail application be allowed.
3. Learned Public Prosecutor opposed the bail application.
4. Heard learned counsel for the petitioner and the learned P.P. present on behalf of the State. Perused the material available on record.
5. Considering the submissions and taking a humanitarian view of the matter, this Court is inclined to grant indulgence of temporary bail to the petitioner to enable him to look after his mother.
6. Accordingly, the instnat interim bail application is allowed. The petitioner shall be released on bail for a period of 30 days from the date of his actual release provided he furnishes a personal bond in the sum of Rs. 50,000/- along with two sound and solvent sureties in the sum of Rs.25,000/- each to the satisfaction of concerned trial court. The order shall be effective from the date of the petitioner's release. The concerned jail authority shall give the date of surrender to the petitioner.
1. Learned counsel for the petitioner seeks withdrawal of the instant bail application with liberty to file afresh after completion of period of interim bail.
2. Accordingly, the instant bail application is dismissed as withdrawn with liberty, prayed for.
3. After surrendering back, the bail application can be moved by the petitioner directly before this Court.
