15/12/2025 S.B. Criminal Writ Petition No. 2985/2025-

Learned counsel for the petitioner submitted that the wife of the petitioner has been advised to undergo immediate surgery for ailment PIVD (Prolapsed Intervertebral Disc.) relating to spinal cord L4 – L5. Learned counsel submitted that in case, the surgery of the petitioner’s wife, who is aged about 45 years, is not carried out soon, she is likely to be immobilized for the rest of her life. Looking at the entirety of the situation and gravity of the medical condition of the petitioner’s wife, it is deemed appropriate that the petitioner be released on interim bail so that he can make necessary arrangements for PIVD surgery of his wife as per the advice of the treating doctors.

Accordingly, this Writ Petition is disposed of. It is ordered that upon the petitioner depositing a sum of Rs.5,00,000/- before the superintendent of jail and provided he furnishes a personal bond in a sum of Rs.2,00,000/- with two sureties of like amount to the satisfaction of the superintendent of jail of concerned jail, he shall be released on interim bail for a period of

30 days from the date of his actual release.

It is made clear that upon the petitioner’s surrendering before the concerned jail authorities after availing the interim bail, the sum amounting to Rs.5,00,000/- deposited by the petitioner shall be refunded to him by the concerned jail authorities.

List the matter for orders after 30 days.
