11/12/2025 The present application (IA No. 02/2025) has been filed by the petitioner seeking a further extension of interim bail earlier granted by this Court, for a period of 120 days on the ground that his wife is due to undergo surgery on her left knee replacement.

Heard learned counsel appearing for the petitioner and learned Public Prosecutor.

Learned counsel for the petitioner submits that the petitioner was initially released on interim bail for 60 days vide order dated 14.08.2025 for the purpose of facilitating the medical treatment of his wife, who had been advised to undergo total knee replacement. It is submitted that although, surgery for one knee was performed, second knee replacement could not be undertaken due to certain complications, and was thereafter scheduled for 22.10.2025. Subsequently, the petitioner again moved this Court for an extension of interim bail and by order dated 14.10.2025, this Court extended interim bail for another 60 days on the same conditions. It is urged that second knee surgery could not be carried out owing to the petitioner’s wife uncontrolled blood pressure and elevated sugar levels. It is further stated that she is presently under treatment and her vital parameters are stabilizing gradually. It is also submitted that left knee replacement surgery is still pending and that considering her multiple medical issues, after operation, complete treatment and recovery would take approximately four months. On these grounds, an extension of interim bail for a further period of 120 days has been prayed for.

Learned Public Prosecutor opposes the application for interim bail and submits that the petitioner has already been granted interim bail on two earlier occasions on the very same ground. It is therefore contended that no sufficient basis exists for any further extension of the interim bail.

Vide orders dated 06.12.2025 and 09.12.2025, this Court directed learned Public Prosecutor to procure medical report of the petitioner’s wife by the next hearing date. In compliance of the same, learned Public Prosecutor has produced the report dated 11.12.2025 along with the treatment prescriptions and medical certificates issued by the treating doctor, forwarded by the Office of the S.H.O., Police Station Kotwali, Sirohi, District Sirohi. The documents state that due to high blood pressure (187/110 mmHg), thyroid issues and high blood sugar levels, surgery of Mrs. Kusum could not be performed. In the aforesaid certificate, it has been opined that patient requires medical regulation and consultation of physician and has been advised to come after one month. However, no specific or scheduled date for the surgery has been provided.

It is pertinent to note that interim bail is an exceptional relief and cannot be extended indefinitely, particularly when the grounds relied upon lack definitiveness and certainty.

Considering the facts and circumstances of the case, the material available on record and the absence of any scheduled date for the left knee surgery of the petitioner’s wife, this Court does not find it appropriate to extend the interim bail at this stage.

Accordingly, present application is dismissed. However, the petitioner will be at liberty to file
