Order

02/12/2025 The present interim bail application under Section 483 of BNSS has been filed by the petitioner, who is in custody in connection with FIR No.21/2025 registered at Police Station Kalu, District Bikaner for the offence punishable under Sections 8/15, 25 of the NDPS Act.

2. Mr. Narayan Ram, father of the petitioner, submitted that marriage of petitioner’s sister is going to be solemnized on 10.12.2025, therefore, the presence of present petitioner, being a brother, is very much essential. In such circumstances, it is prayed that the petitioner may be released on interim bail for a period of thirty days.

3. Learned Public Prosecutor has opposed the interim bail of the accused-petitioner but does not dispute the fact that the marriage of petitioner’s sister is going to be solemnized on 10.12.2025. Learned Public Prosecutor placed on record a copy of the factual report dated 02.12.2025 sent by SHO Police Station Kalu District Bikaner certifying the fact that marriage of the sister of the petitioner is going to be solemnized on 10.12.2025.

Having considered the facts and circumstances of the case and the fact that the marriage of petitioner’s sister is going to be solemnized on 10.12.2025, the presence of the present petitioner, being a brother, is very much essential, therefore, this Court deems it just and proper to grant interim bail to the accused petitioner for a period of 20 days.

5. Accordingly, the interim bail application filed under Section 483 of B.N.S.S. is allowed and it is directed that petitioner Dinesh S/o Narayan Ram, arrested in connection with FIR No.21/2025 registered at Police Station Kalu, District Bikaner for the offence under Sections 8/15, 25 of the NDPS Act be released on interim bail for a period of 20 days, provided he furnishes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties in the sum of Rs.50,000/- (both the sureties will be a close relatives of the petitioner) each to the satisfaction of learned trial Court for his surrender on completion of 20 days from the date of actual release.

6. Let the bail application be again listed on 02.01.2026 Learned Public Prosecutor shall be required to submit the compliance report of the order as to whether the petitioner has surrendered or not.
