1. The matter was listed on 24.11.2025, wherein on urgency being shown by the learned counsel for the petitioner, notices were issued and liberty was granted to the learned counsel for the petitioner to serve the respondents through their regularly appearing counsel and the matter was posted today i.e.
25.11.2025.
2. Today when the matter was called, learned counsel for the petitioner submitted that an advance copy has been duly served by her upon the counsel regularly appearing for the respondents and they have been duly informed about the matter and the urgency involved therein.

Submission of the learned counsel for the petitioner is that the National Council for Teacher Education (NCTE) vide its order dated 10.05.2008 has granted recognition to the petitioner for conducting B.P.Ed course of one year with an annual intake of 50 students, thus, it had all the reason to believe that its name would on 17.09.2025, it was learnt by the petitioner that for reasons best known to the respondents its name has not been included in the list.
4. Consequently, all the remedies and steps were taken by it which culminated into issuance of NOC to it by the respondent No.2-Commissioner, College Education on 15.10.2025 for 50 seats. The information with respect to the said NOC was duly communicated by it to the respondents, however, it was not permitted to participate in the counselling. Thus, the present writ petition has been filed.

It has been further stated that the counselling for the year 2025-26 has been conducted and even the 5th counselling round has continued till 19.11.2025 but for no fault of the petitioner, despite having the requisite NOC and recognition, it has been deprived from participation in the counselling process. Thus, the prayer is to direct the respondents to conduct stray/special counselling for the seats remaining vacant even after the 5th round of counselling.

The submission made above with respect to recognition being granted by the NCTE vide order dated 10.05.2008 and consequent NOC being issued by the Commissioner, College Education on 15.10.2025 is a matter of record and there is no such apparent reason available on record for which the petitioner could have been denied participation in the counselling process.

Thus, considering the fact that 5th round of counselling has already ended on 19.11.2025, the respondent No.3 is directed to conduct stray/special counselling for the seats remaining vacant after the 5th round of counselling by including the petitioner- college, within a period of seven days from tomorrow i.e.
26.11.2025.
8. In addition to filing reply to the writ petition, in case the respondents dispute any of the contentions raised and facts stated by the petitioner, they would be at liberty to prefer appropriate application seeking vacation/modification of this interim order. It is also clarified that the directions issued herein being of interim nature, would not create any equity in favor of the petitioner and their fate would remain subject to the final outcome of the writ petition.
9. List the matter after four weeks.
