1. By way of filing the present writ petition under Article 226 of the Constitution of India, the petitioner has prayed for the following reliefs:-

“It is, therefore, most respectfully and humbly prayed that the instant writ petition may kindly be allowed and a writ, order or direction in the appropriate nature may kindly be issued in favour of the humble petitioner;

and I) The respondents may kindly be directed to grant temporary NOC for M.SC. (Physics), M.A. (Geography) & new subjects in B.A. (Computer Application) (Home Science) and (Drawing and Painting) and further, process the application for grant of NOC.

ii) Any other order of direction, which this Hon’ble Court deems fit and proper in the facts and circumstances of the present case may kindly be passes in favour of the humble petitioner institution.”

2. Learned counsel appearing on behalf of petitioner submitted the inspection of the petitioner- Institution for conducting/ running three new courses viz. M.SC. (Physics), M.A. (Geography), B.A. (Computer Application) (Home Science) and (Drawing and Painting) has already been conducted by the respondent No.2. Therefore, the respondent No.2 may be directed to take a final decision with regard to the grant of NOC to the petitioner for running the aforementioned new courses within a period of one month from today.

3. Per contra, Shri Tananjay Parmar, associate to Shri Deepak Bora, learned AGC submits that he may be granted some time to complete his instructions as he is not aware about the current status of the application submitted by the petitioner- Institution seeking NOC for running three new courses.

4. Heard learned counsel for the parties. Perused the material available on record.

5. In view of the fact that the petitioner- Institution has confined its prayer for seeking a direction upon the respondents to decide the application with regard to the grant of NOC for conducting/ running three new courses viz. M.SC. (Physics), M.A. (Geography), B.A. (Computer Application) (Home Science) and (Drawing and Painting), this Court deems it just and appropriate to dispose of the instant writ petition with a direction to the respondent No.2 to consider and decide the application filed by the petitioner- institution seeking NOC as early as possible within a period of two months from the date of this order.

6. With the aforesaid directions, the present writ petition as well as stay application stands disposed of.
