Order

05/08/2025 The present interim bail applications under Section 483 BNSS have been filed by the petitioners on the ground that wedding of their sister is scheduled to be held on 07.08.2025. Therefore, the presence of the petitioners being her brothers is essential. In such circumstances, it is prayed that the petitioners may be released on interim bail for a period of 10 days.

2. Learned Public Prosecutor has produced the factual report dated 05.08.2025 indicating the factum of marriage of the petitioners’ sister.

3. Having considered the facts and circumstances of the case, this Court deems it just and proper to grant interim bail to the accused petitioners for a period of 10 days.

4. Accordingly, the interim bail applications filed under Section 483 of B.N.S.S. are allowed and it is directed that petitioners (1) Saddam S/o Safi Mohd and (2) Ajahruddin S/o Safi Mohd. arrested in connection with F.I.R. No.17/2025, registered at Police Station Anandpur Kalu, District Beawar for the offence under Section 8/15 of the NDPS Act and Section 3/25 of the Arms Act, be released on interim bail for a period of 10 days, subject to the condition that each of them shall deposit a sum of Rs.2,00,000/- before the trial court and provided each of them furnishes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties in the sum of Rs.50,000/- (out of which one surety will be a close relative of the petitioner) each to the satisfaction of learned trial court for their surrender on completion of 10 days from the date of actual release.

5. If the petitioners surrender within the stipulated period before the concerned Jail, then the amount of Rs.2,00,000/- so deposited by each of the petitioners before the trial court shall be refunded back to them whereas if the petitioners fail to surrender within the stipulated period, then the amount so deposited shall be forfeited immediately.

6. Let these bail applications be again listed on 25.08.2025. Learned Public Prosecutor shall be required to submit the compliance report of the order as to whether the petitioners have surrendered or not.
