ORDER

31/07/2025 The matter is listed on an application (I.A. No.1/25)

preferred by the respondent No.2 – complainant seeking correction in the order dated 29.7.2025 passed by this Court in S.B. Criminal Misc. Petition No.6048/2025.

Today morning, learned counsel for the respondent No.2 –

complainant appeared before the Court and made a mention that the above criminal misc. petition was listed before this Hon’ble Court on 29.7.2025 at Sr.No.75. He further submitted that the Hon’ble Court after hearing arguments of learned counsel for the parties, was pleased to direct the learned Public Prosecutor to call for the case diary and the matter was ordered to be listed in the Court on 11.8.2025. However, it appears that due to inadvertence, the concerned Stenographer has drawn a wrong order-sheet and has granted interim stay on the arrest of the petitioner which was not actually dictated by the Hon’ble Court. He thus implored the Court to make necessary correction in the order dated 29.7.2025.

In order to verify the above contention of the learned counsel for the complainant, this Court has summoned the relevant record from the Court Master.

Upon a perusal of the cause-list (result) dated 29.7.2025 maintained by the Court Master, the averment raised by learned counsel for the complainant respondent No.2 is concurred.

The concerned Stenographer cum Jr.P.A. Shri Dinesh Jangid was also called and was asked to read the dictated portion of the order dated 29.7.2025 upon which it was found that the contention raised by learned counsel for the complainant respondent No.2 is correct.

Since Shri Dinesh Jangid (Stenographer cum Jr.P.A.)

furnished his unconditional apology for typing wrong order the same was accepted and he was directed to remain more cautious in future.

In view of the above factual matrix, this Court prima-facie satisfied that the order dated 29.7.2025 needs to be corrected.

Accordingly, the instant misc. application is allowed. The corrected order dated 29.7.2025 is reproduced hereinbelow:

“1. Learned Public Prosecutor is directed to call for the case diary on the next date of hearing.

2. List the matter on 11.08.2025.”

The original order dated 29.7.2025 be kept in D-Part of the file and the same be offloaded from the web-site of High Court and instead, the corrected order dated 29.7.2025 be now uploaded.
