1. The instant bail applications have been filed by petitioners under Section 483 B.N.S.S. in connection with FIR No.43/2025 dated 17.02.2025 registered at Police Station Panchu, District Bikaner for the offences under Sections 115(2), 126(2), 329(3), 117(2), 110, 3(5), 189(2) of BNS.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the case while alleging that the petitioners along with other co-accused caused serious injuries to the complainant when an altercation took place between them. He submits that none of the injuries are dangerous to life or on the vital part of the body and the injuries are simple in nature. He also submits that charge-sheet have filed and no recovery is due against the petitioner, thus the petitioners deserve to be enlarged on bail.

4. Per contra, learned Public Prosecutor oppose the bail applications, however, is not in a position to refute that none of the injuries are dangerous to life. He further submits that as per the injury report, complainant sustained as many as seven injuries, out of which, injury nos.2, 6 and 7 are grievous in nature and rest of the injuries are simple in nature.

Considering the arguments advanced by the learned counsel for the petitioners and the learned Public Prosecutor as well as the facts and circumstances of the case as available on record and without commenting on the merits of the case, this Court is of the opinion that no useful purpose would be served by keeping the present petitioners behind the bars for further period till disposal of the case and also looking to the possibility that the trial may take long time to conclude, this Court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners Sunil S/o Raja Ram and Raja Ram S/o Manphool Bishnoi, arrested in relation to FIR No.43/2025 dated 17.02.2025 registered at Police Station Panchu, District Bikaner shall be enlarged on bail provided they furnish a personal bond in sum of Rs.50,000/- each with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing as and when called upon to do so.
