1. In the present bunch of matters, allegations leveled against the applicants pertain to commission of Cyber crime(s), wherein they have moved applications seeking anticipatory/ regular bail under Section 482 BNSS and Section 483 BNSS, respectively.
2. Upon perusal of the material available on record, this Court has noted that present batch of applications involve following common factual matrix:-
2.1. That all the applicants are aged approximately 18 to 20 years.
2.2. That they have been alleged of committing a cyber crime.
2.3. That complaints are filed by the police authorities and not by the victim(s) or any private person.
2.4. That in few of the matters, charge-sheet has been filed.
2.5. That matters are triable by Magistrate.
3. Learned counsel for the applicants have submitted that FIRs are lodged merely on the basis of suspicion and presumption and assumption, without any justifiable reasons, thereby affecting personal liberty of the applicants. It is further submitted that few accused persons are taken into custody by the police authorities and their bank accounts have been seized.
4. Learned GA cum AAG along with Superintendent of Police, Cyber Crime and amicus curiae have marked presence in the Court and have explained the matter conscientiously, whereby, they have enlightened and apprised the Court qua various types of cyber frauds including digital arrests, investment scams, sextortion rackets and fake loan applications.
5. Further, it is submitted that cyber crime has been committed in an organized manner, by remitting the money in majority of the cases which are linked to international companies situated in various Gulf, African countries. Moreover, the said money is utilized in funding national campaign, terrorism and other activities.
6. Furthermore, it is submitted that mule and rented accounts are used for committing the alleged offence. Additionally, applications like ‘Olx’ are created. Moreso, mobile phones and SIM are used in an unauthorized manner, qua which victims are also unaware.
7. Subsequently, it is submitted that State is making endevours to curb the said crime by using preventive, curative & reformative approach.
8. Further, it is submitted that in order to generate easy money, youth is instigated to participate in unauthorized gaming and other activities. It is submitted that once money is received, the said amount is transferred or remitted by using multiple accounts which are either rented, hacked or used in an ignorant manner.
9. Superintendent of Police and amicus curiae have assured to furnish a White paper qua the above aspect, by the next date of hearing.
