1. These bail applications have been filed under Section 483 of BNSS, 2023 on behalf of accused-petitioners in connection with FIR No.327/2025 registered at Police Station Pilani, District Jhunjhunu for the offences under Sections 103(1), 55, 61(2)(a) of
BNS, 2023 and Section 3/25 Arms Act.
2. Heard.
petitioners as well as learned Public Prosecutor.
4. The present criminal case has been registered on the statement of one Himanshu who was arrested in a criminal case bearing FIR No.320/2025. It has been alleged that he and Sachin Meghwal were given an amount of Rs.15,00,000/- at the instance of Anuj Sharma for committing murder of one Dr. Arti.
5. The allegation against the accused-petitioners is for offences punishable under Section 103(1) read with Section 55 and Section
3/25 Arms Act.
6. On perusal of the case diary, it is revealed that the allegation against the both the accused-persons is of a part of conspiracy. It has also come out that the Police issued a notice to the accused- petitioner-Kajal Patel under Section 35(2) BNSS for her appearance before the Investigating Officer on 15.12.2025 for investigation.
7. Though, the accused-petitioner-Kajal Patel was to appear before the Investigating Officer upto 15.12.2025 however, she was arrested a day before the scheduled date.
8. No explanation has been given in the case diary as regards why has been arrested a day before scheduled date when she was to appear before the Investigating Officer on 15.12.2025.
9. The accused-petitioners have been implicated as an accused on the basis of having call conversation with the other co-accused persons.
10. Learned Public Prosecutor vehemently opposed the bail applications.
petitioners and so also the fact that one of the accused-petitioner, namely, Kajal Patel is a woman and they are in custody and the allegation against them is a part of conspiracy of an offence of abatement, this Court without expressing any opinion on the merits/demerits of the case deems just and proper to enlarge the accused-petitioners on bail.

Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners named above shall be enlarged on bail provided, each of them furnish a personal bond in the sum of Rs.1,00,000/- together with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
