1. The petitioners have filed this anticipatory bail application under Section 482 B.N.S.S. arising out of F.I.R. No.347/2025 registered with the Police Station, Sikandra, District Dausa for offence under Section 303(2) of B.N.S., 2023.
2. Learned counsel for the petitioners submits that the First Information Report has been lodged as regards the theft of certain goats against some unknown person. He further submits that the petitioners have falsely been implicated in this case and the Court vide order dated 15.12.2025, directed the petitioners to appear before the Investigating officer. He also submits that the petitioners have already appeared before the Investigating Officer and have already been interrogated. It is also submitted that the petitioners are no more required for any kind of interrogation or recovery. Therefore, the petitioners may be enlarged on bail.
3. Learned Public Prosecutor has opposed the anticipatory bail application and verifies the fact that the petitioners have appeared before the Investigating Officer and has been interrogated in view of the direction of the Court.
4. Considered the submissions made by learned counsel for the petitioners as well as the learned Public Prosecutor and the material available on record.
5. Taking into consideration the overall facts and circumstances of the case and so also the allegation against the petitioners and the fact that they have already appeared before the Investigating Officer and joined the investigation, this Court deems just and proper to extend the benefit of anticipatory bail to the petitioners.
6. The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station Sikandra, District Dausa in F.I.R. No. 347/2025 is directed that in the event of arrest of the petitioners they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to his satisfaction on the following conditions:-
(I). that the petitioners shall make themselves available for interrogation by a police officer as and when required;
(ii). that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and (iii). that the petitioners shall not leave India without previous permission of the Court.
