14/01/2026 Heard learned counsel for the parties.

The instant writ petition has been preferred by the petitioner (brother of convict-prisoner Kishan Lal) for releasing the convict-

prisoner on first parole of 20 days.

Learned counsel for the petitioner submits that the petitioner has completed incarceration of almost 09 years and he is entitled to be released on first parole. He further submits that the District Parole Advisory Committee has committed an error while passing the order dated 17.04.2025, whereby petitioner’s parole application has been rejected. He further submits that the ground for rejection of petitioner’s parole application is not just, proper and correct. He further submits that the conduct of the petitioner in jail has been found satisfactory and the petitioner is meeting all the criteria for releasing him on first parole under the Rajasthan Prisoners Release on Parole Rules, 1958. He, therefore, prays that the writ petition may be allowed and the convict-petitioner may be released on first parole of 20 days.

Learned Additional Advocate General appearing for the respondent-State has opposed the submissions made by the learned counsel for the petitioner and submits that the reasons recorded by the District Parole Advisory Committee are absolutely right as the petitioner has been convicted under heinous offence. He further submits that releasing the petitioner on parole would create disturbance to the complainant’s family members. He, therefore, prays that no interference is warranted.

We have considered the submissions made before us. We are of the view that since the petitioner has completed incarceration of 09 years and no untoward incident has been reported by the jail authorities. Merely on this ground that petitioner’s release on parole will create threat to the complainant party is not proper more particularly, when there is no foundation of rejecting the parole application of the petitioner by the District Parole Advisory Committee. This Court is of the view that granting of parole to the convict is solely for the purpose of allowing him to re-connect with his family members and re-kindle the bonds, which were snapped.

Accordingly, the instant writ petition is hereby allowed and it is ordered that the convict Kishan Lal S/o Shri Shankar Lal Ji shall be released on first parole of 20 days upon his furnishing a personal bond in the sum of Rs.50,000/- with two duly verified sound and solvent sureties of Rs.25,000/- each to the satisfaction of Superintendent Central Jail, Sri Ganganagar on the usual terms and conditions. The Superintendent, Central Jail, Sri Ganganagar shall be at liberty to impose other adequate and reasonable conditions to ensure return of the convict to the custody after availing the emergent parole. The term of emergent parole shall be computed from the date of his actual release.
