23/01/2026 The present interim bail application under Section 483 of BNSS (439 Cr.P.C.) has been filed by the petitioner who has been arrested in the present matter. The requisite details of the matter are tabulated herein below:

Learned counsel for the petitioner submits that the petitioner’s father namely-Shri Ram Lal Dhakar, who suffered brain stroke, is suffering from paralysis and is unable to walk. He is in need of constant medical attention and care. It is further submitted that the petitioner’s brother has been living separately for a long time due to family dispute, therefore, the petitioner is the only male member of the family available to attend the domestic responsibilities. In support of the aforesaid submissions, learned counsel for the petitioner has relied upon the medical reports of the petitioner’s father. It is, therefore, prayed that the petitioner be released on interim bail for a period of 30 days. Vide order dated 16.01.2026, a Coordinate Bench of this Court directed the learned Public Prosecutor to submit a status report.
Today, learned Public Prosecutor has produced a report dated
18.01.2026 received from the office of the SHO, Police Station Parsoli, District Chittorgarh along with the medical documents. A perusal thereof indicates that the petitioner’s father is paralyzed, unable to walk and requires medical attention and care. The said report is taken on record.
Learned Public Prosecutor has opposed the prayer for interim bail, however, he is not in a position to dispute the fact of ailment of petitioner’s father.
Having heard learned counsel for the parties and considered the facts and circumstances of the case, so also the fact that the petitioner's father is suffering from paralysis, is unable to walk and is in need of constant medical attention and care, without expressing any opinion on merits/demerits of the case, this Court deems it just and proper to grant interim bail to the accused petitioner for a period of 30 days.
Accordingly, interim bail application filed under Section 483 of BNSS (439 Cr.P.C.) is allowed and it is ordered that the accused-petitioner as named in the cause title, arrested in connection with the above mentioned FIR, shall be released on interim bail for a period of 30 days, subject to the condition that the petitioner shall deposit Rs. 3,00,000/- with the concerned Superintendent of Jail and furnishes two sound and solvent sureties in the sum of Rs.1,00,000/- (out of which one surety will be of a close relative of the petitioner) each to the satisfaction of learned trial court for his surrender on completion of 30 days from the date of actual release.
If the petitioner surrenders within the stipulated period before the concerned Jail, then amount so deposited before the Superintendent of Jail concerned shall be refunded back to him whereas, if the petitioner fails to surrender within the stipulated period, then amount so deposited shall be forfeited immediately.
Let this bail application be again listed on 25.02.2026.
Learned Public Prosecutor shall be required to submit the compliance report of the order whether petitioner has surrendered or not.
