Order
21/01/2026
1. These bail applications have been filed by the accused petitioners u/S 483 BNSS in connection with FIR No. 335/2025, registered with the Police Station Gangapur City, District Sawai Madhopur for offences punishable u/S 338, 336(3), 336(4), 340(2), 318(2), 318(4), 319(2) and 61(2) of BNS.
2. Heard and considered the submissions made by the learned counsel for the accused-petitioners as well as the learned Public Prosecutor and also perused the case diary.
3. The allegation against the accused petitioners is that in collusion with the other accused, they prepared the forged patta to grab the land of the complainant.
4. It is submitted by the learned counsel for the accused petitioners that the accused Deepak is the Storekeeper in the Municipal Council and the accused Ramprasad is Stenographer in that Council. He further submitted that the accused petitioners have been implicated in this case merely on suspicion. It is also submitted that the accused petitioners are in custody since 23.12.2025 and they are no more required for any kind of interrogation or recovery and the offences alleged against them are triable by Magistrate.
5. Learned Public Prosecutor vehemently opposed the bail application and submits that there is ample evidence collected during the investigation which shows the connection of the accused petitioners in preparing the forged documents.
6. The forged patta has been issued in the name of Asha Singhal and in that situation the petitioners cannot be said to be the beneficiaries, however they could be in collusion for preparing the forged patta. The accused petitioner are the employee and the offences alleged against them are triable by Magistrate and they are in custody since 23.12.2025, hence, this Court, without expressing any opinion on merits/demerits of the case, deems just and proper to enlarge the accused petitioners on bail.
7. Accordingly, these bail applications are allowed and it is directed that accused-petitioners shall be released on bail provided that they furnish a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only)(each), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the Trial Court with the stipulation that they shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
