1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 35/2025 registered at Police Station Special Police Station-SOG, District ATS & SOG for the offences under Sections 420 and 120-B of IPC and Sections 4, 5 and 6 Rajasthan Public Exams (Prevention of Unfair Means) Act, 1992 and Section 66D of IT Act.

2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that there is no substantive evidence available on record that the petitioner in connivance with the other co-accused Poran Kaler and Rajaram supplied papers to the candidates in the LDC examination conducted in the year 2018 by the Rajasthan Public Service Commission (RPSC). It is also contended that the FIR itself is delayed by almost 7 years and the petitioner was also falsely implicated in 3 other cases and after granting of bail in other cases, he has been arrested in the present case. There is no evidence to the fact that the petitioner unauthorisedly appoint Rajaram as invigilator in the school and with the connivance with the Rajaram leaked papers of the examination of LDC. The petitioner has been enlarged on bail in other similarly alleged matters. The petitioner is in custody since 19.08.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application and contended that the petitioner in connivance with the other co-accused notably Rajaram and Poran Kaler provided the papers to the candidates. It is also contended that the petitioner was running senior secondary school at Bikaner and voluntarily kept co-accused Rajaram who was not authorized teacher in his examination centre as invigilator. It is also contended that the petitioner has Modus Operandi with co-accused Rajaram & other co-accused in examination conducted by the RPSC with the aid of Rajaram. Petitioner provided leaked papers to co-accused Poran Kaler and through Poran Kaler, the paper was supplied to the candidates who appeared in the examination. Thus, the investigation revealed that the petitioner was found to be involved in the said offence and illegally provided the leaked papers through Rajaram and Poran Kaler, therefore, considering the allegation levelled against the petitioner, therefore, the bail application of the accused-petitioner may be allowed.

5. Considering the factual report submitted by the learned Public Prosecutor and the arguments made on behalf of the State, this Court is not inclined to enlarge the petitioner on bail.

6. Accordingly, the bail application of the accused-petitioner is hereby dismissed.
