1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 04/2025 registered at Police Station Cyber Police Station (ATS & SOG), District ATS & SOG for the offence(s) under Sections 308(6), 318(4), 319(2), 204 and 111(4) of BNS and Section 66-D of IT Act.

2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is contended by learned counsel for the petitioner-Kamlesh that the other co-accused have been discharged by the sessions court for the offence under Section 111(4) of BNS and the matter has been sent to the concerned magistrate for trial. It is alleged against the petitioners that they digitally arrested the complainant and by threatening him obtained an amount of Rs. 23,56,000/- (twenty three lakh fifty six thousand). It is alleged against the petitioner Kamlesh that he misused the account of child in conflict with law-'X' and further provided it to other co-accused and in the account of child in conflict with law, some amount was deposited. There is no evidence to the fact that petitioner has misused the account maintained by child in conflict with law 'X'. The matter is exclusively triable by Magistrate and the accused-petitioner is in custody since 07.10.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-

petitioner may be allowed.

Learned counsel for the petitioner-Sher Mohd contended that there is no direct link between the petitioner and the other co- accused who committed the offence and the petitioner has not committed any fraud or cyber offence with the complainant. The accused-petitioner is behind the bars since 14.10.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

3. Learned Public Prosecutor has vehemently opposed the bail applications and submitted the detailed factual report, the same is taken on record. It is contended that petitioners in connivance with the other co-accused digitally arrested the complainant and threatened him for arrest and huge amount was transfered in the account of child in conflict with law-'X' which was used by the present petitioner Kamlesh and further provided it to other co- accused Praveen Chaudhary. The call details and whats-app chat transpired between the petitioner Kamlesh and other co-accused were obtained during investigation confirming the aforesaid fact. It is also contended that similarly in the account maintained by Sher Mohd at Punjab National Bank Rs. 2,00,400/- (two lakh four hundred) and 3,94,570/- (three lakh ninety four thousand five hundred seventy) were deposited in a portal maintained for the parties for commission of cyber offence.
