1. The instant bail application (I.A No. 01/2023) has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 227/2022 registered at Police Station Bekariya, District Udaipur for the offences under Sections 419, 420 and 120-B of IPC and Sections 3, 4, 6 and 6(a) of Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992 and Sections 3, 6, 9 and 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.

2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that accused-petitioner is in custody since

06.04.2023 and charges have not yet been framed. It is further contended that other similarly placed co-accused Arun @ Rajendra, Rajeev, Vijay, Bhupendra, Kamlendra, Gopal, Omprakash and other co-accused have already been granted on bail. The bail application of other co-accused Bhupendra was allowed by this Court, considering the long incarceration and same was challenged before the Hon'ble Apex Court which dismissed the bail cancellation application in limine vide order dated 03.11.2025. It is further contended that all the other cases pending against the accused-petitioner was registered after filing of this present FIR. It is also contended that accused-petitioner is in custody since long and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application and contended that the petitioner was the kingpin in providing the papers to the candidates and huge amount of money was also effected from the petitioner and mobile phone of the petitioner was also recovered in which leaked questions of the exam paper were found. It is also contended that on the basis of the scheduled offence, PMLA case was also registered against the petitioner and similar nature of cases were also registered against the petitioner, therefore, the bail application of the accused-

petitioner may be dismissed.

4. Heard and perused the material available on record.

5. Considering the fact that the co-accused Arun @ Rajendra, Rajeev, Vijay, Bhupendra, Kamlendra, Gopal, Omprakash and other co-accused have already been enlarged on bail. Admittedly, charges against the petitioner and other co-accused have not yet been framed, though, the arguments on charge have been advanced, there is a long list of witnesses to be examined and the case contains voluminous documents and petitioner has remained in custody for a long period, trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Anil Kumar Meena @ Sher Singh Meena S/o Shri Gopal Meena, in connection with FIR No. 227/2022 registered at Police Station Bekariya, District Udaipur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the
