1. Learned counsel for the petitioners has submitted a copy of the order No. F (71/DME/Acad./SR/NOC/2025-00682/2042), dated 01.12.2025, issued by the Office of Commissioner, Medical Education Department. The said order reads as under:-

"राजसान सरकार ननदेशालय नचनकता नशका नवभाग नचनकता नशका भवन नपंक एकवाईर गॉल के पास गोनवन भागर जयपुर ई-मेल addidir.medical edu@rajasthan.gov.in No.F(71/DME/Acad./SR/NOC/2025-00682/2042 Date: 01/12/2025 -आदेशः -

राज मे पीजी एवं सुपरसेनशयनलटी के अभनररयों दारा दो वरर के सनवरस बॉण की अनुपालना की जाती है। उक अभनररयों को के द सरकार अरवा राज सरकार मे चयन होने पर जोइं ननंग हेतु अनापनत पमाण पत (NOC) एवं बॉण मे छू ट की मांग की जाती है। इस संबंध मे राजसान सेवा ननयमों के अनुसार यह ननदरशनशत नकया जाता है नक यनद "कोई अभरर के नीय सरकार, राज सरकारो,ं पूणर रप से अरवा आनशक रप से के नीय सरकार अरवा राज सरकार दारा अनधकृ त संसान अरवा अन नकसी अरर-राजकीय संगठन मे ननयोजन पाप करने हेतु राज सेवा छोड देता है, तो उस पर भरे हए बांड की शतर पभावी नही ं होगी" के

अनुसार अनापनत पमाण पत (NOC) एवं रॉण मे छू ट दी जावेगी।

उक आदेश जारी नदनांक से पभायी रहेगा।

Referring to the said order, learned counsel for the petitioners submits that as the petitioner No.1 – Dr. Amit Prakash S/o Vijay Prakash and petitioner No.2 – Dr. Amit Kumar S/o Ravindra Tiwari, have been issued appointment orders dated 11.09.2020 and 02.09.2021 respectively, by the Department of Health, Government of Bihar, hence, in light of the order dated 01.12.2025, the petitioners deserve to be exempted from the bond conditions furnished by them to the State Government.

3. The fact that the petitioners were issued the appointment orders dated 11.09.2020 and 02.09.2021 by the Department of Health, Government of Bihar, is not disputed by the counsel for the respondent.

4. Accordingly, considering the order dated 01.12.2025 issued by the Officer of Commissioner, Medical Education Department, State of Rajasthan, the present writ petition is allowed with the direction to the respondents not to bind the petitioners with the terms and conditions of the bond furnished by them and to release the documents of the petitioners forthwith.

5. Pending application(s), if any, stand disposed of.
