1. These anticipatory bail applications have been filed under Section 482 of BNSS, 2023 on behalf of accused-petitioners in connection with FIR No.492/2025 registered at Police Station New Mandi Hindaun, District Karauli for the offences under Section 13 of the Rajasthan Public Gambling Ordinance, 1949 and Section

112(2) of BNS, 2023.

2. Heard.

3. Considered the submissions made by counsel for the accused-petitioners as well as learned Public Prosecutor and also perused the factual report and so also report of the Investigating Officer.

4. The allegation against the accused-petitioners is of an offence punishable under Section 13 of the Rajasthan Public Gambling Ordinance, 1949 and Section 112(2) of BNS, 2023.

5. The Court vide order dated 18.12.2025 directed the accused- petitioners to appear before the Investigating Officer on or before

30.12.2025.

6. It is submitted by counsel for the petitioners that under the directions of this Court dated 18.12.2025, the accused-petitioners have appeared before the Investigating Officer who is interrogated them. It is further submitted that since the interrogation has already been made, the accused-petitioners are not required for any kind of interrogation or recovery.

7. It is also submitted that the accused-petitioners have been implicated in this case based on false and fabricated story by the Police itself without there being any victim.

8. Learned Public Prosecutor vehemently opposed the bail applications.

9. Having regard to the submissions made by counsel for the petitioners and taking into consideration the allegations against the accused-petitioners and so also the fact that they have already interrogated by the Investigating Officer, this Court without expressing any opinion on the merits or demerits of the case deems just and proper to extend the benefit of anticipatory bail to the accused-petitioners.

Accordingly, these anticipatory bail applications under Section 482 B.N.S.S. are allowed and it is ordered that in the event of arrest of the accused-petitioners named above in connection with FIR No.492/2025 registered at Police Station New Mandi Hindaun, District Karauli shall be released on bail, provided each of them furnish a personal bond in the sum of Rs.1,00,000/- together with two sureties in the sum of Rs.50,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioners shall not leave India without previous permission of the court.
