1. The second application for bail filed under Section 483 of BNSS by the applicant-accused Arjun Singh Ranwat S/o Shri Durga Singh in FIR No. 35/2025 dated 05.05.2025 registered at P.S. Kaithunipol District -Kota City, whereby the applicants-accused were charged under Sections 189(4), 332(c), 308(2), 308(5), 111(2)(b) and 111(4) of BNS.

2. Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there is no chance of the applicant accused fleeing from the jurisdiction of this Hon’ble Court. The applicant does not have any criminal antecedents. He also submits that the applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time.

Learned counsel for the petitioner submits that this Hon’ble Court has dismissed the bail application on 11.08.2025 when the petitioner was charged under Sections 111(2)(b) and Section 111(4) of BNS, but after the charge order dated 05.12.2025, all the accused were discharged from the offence under Section 111(2)(b) and Section 111 (4) of BNS. He further submitted that an identically placed person, Harvinder Singh, was released by the trial court on 05.12.2025, whereas Arvind Singh was released on bail on 17.12.2025. He further submitted that one of the accused, Mahendra Puri, was released on bail by the learned Sessions Judge on 20.05.2025. He also submitted that accused Shiv Panwar @ Chandrashekar, was released by a coordinate Bench on this Hon’ble Court on 01.12.2025. He submitted that the case of the present petitioner is on better footing than those who were released on bail. At last, he submitted that the main accused is Mahendra Puri and recovery was effected from Jagveer Singh and Ranjit Singh.

4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature.

5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties.

6. The first bail application of the present petitioner was dismissed by this Hon’ble Court on 11.08.2025, and we have observed as under:

“On the basis of report dated 05.05.2025 lodged by Vinay Goswami Ji Maharaj about unauthorized entry of 8-10 armed persons with Mahendra Puri on 04.05.2025 and intimidation about management and possession of land of temple, FIR No.35/2025 is registered at P.S. Kaithunipole, Kota City. During investigation, police has identified role and involvement of petitioners and other individuals and arrested them. During investigation, police has recovered fire arms from present petitioners Jagveer Singh and Ranjeet Singh. As per police, these petitioner are members of gang of Shivraj Singh, who is kingpin of organized crime, in Kota region. The police has filed detailed list of 39 members, affiliated to his gang. As per criminal antecedents submitted by police, two criminal cases were registered against Arjun Singh Ranawat. After investigation, police has filed charge-sheet against 10 persons. As per order of trial court, there is no criminal antecedents against Jagveer Singh and Ranjeet Singh but both are not residents of Kota and they were found at Kota on date of incident.
