This application for bail under Section 483 of BNSS has been
filed by the petitioner who has been arrested in connection with
F.I.R. No.178/2023 registered at Police Station Sadar, District
Barmer for offences under Sections 8/15 & 25 of the NDPS Act
and Section 3/25 of Arms Act and Section 420 & 465 of the IPC.
Heard learned counsel for the petitioner, learned Public
Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submitted that as per the
prosecution, in the intervening night of 25.05.2023, the SHO PS
Sadar, District Barmer recovered a huge recovery of contraband
(poppy-husk) from three vehicles i.e. one Eicher truck bearing
No.RJ-04-GC-1673, unnumbered Scorpio and Isuzu.
Learned counsel submitted that the allegation against the
present petitioner is that he along with co-accused persons

namely Bira Ram, Kojaram, Dharma Ram and Hanuman Ram were
transporting the recovered contraband in the offending vehicle. He
further submitted that the petitioner has falsely implicated in the
present case; the contraband has not been recovered from the
conscious possession of the present petitioner; co-accused
persona namely Kojaram (S.B. Crl. Misc. Second Bail Application
No.6491/2024) Babu Lal (S.B. Crl. Misc. Bail Application
No.3382/2025) and Prakash Choudhary (S.B. Crl. Misc. Bail
Application No.8476/2025) have already been enlarged on bail by
this Court vide orders dated 16.10.2025, 15.09.2025 and
06.12.2025.
Learned counsel for the petitioner further submitted that the
case of the present petitioner is not worse than the case of above
named co-accused persons who have already been enlarged on
bail. Lastly, learned counsel for the petitioner submitted that the
petitioner is in judicial custody and the trial of the case is likely to
consume sufficiently long time. On these grounds, he implored the
Court to enlarge the petitioner on bail.
Per contra, learned Public Prosecutor vehemently opposed
the bail application. However, he was not in position to refute the
fact that the above named co-accused persons have already been
enlarged on bail.
Having considered the rival submissions, facts and
circumstances of the case, without expressing any opinion on
merits/demerits of the case, this Court is inclined to enlarge the
petitioner on bail.

Consequently, the bail application under Section 483 of BNSS
is allowed. It is ordered that the accused-petitioner Mangla Ram
S/o Shri Pema Ram, arrested in connection with F.I.R.
No.178/2023 registered at Police Station Sadar, District Barmer
shall be released on bail, if not wanted in any other case, provided
he furnishes a personal bond of Rs.50,000/- and two sureties of
Rs.25,000/- each, to the satisfaction of learned trial court, for his
appearance before that court on each & every date of hearing and
whenever called upon to do so till completion of the trial.
It is however, made clear that findings recorded/observations
made above are for limited purposes of adjudication of bail
application. The trial court shall not get prejudiced by the same.
