Order
1. With the consent of learned counsel for both parties, the writ petition is heard on final disposal at the admission stage itself.
2. The present writ petition has been filed challenging the action of the respondents in not allowing the extension of time to the petitioners for joining on the post of Medical Officer till the completion of tenure of one year of the Senior Residency.
3. The grievance of the petitioners is that the petitioners have further three months to complete their Senior Residency course. On account of cut-off date given in the previous extension by the Government, if the petitioners do not join on the post of Medical Officer by 11.02.2026, their appointment will automatically get terminated. In the said circumstances, the petitioners have made a representation dated 16.01.2026 before the respondents for extension of time; however, no action has been taken on such representation. Therefore, they seek mandamus to consider such representation.
4. This Court finds that when a representation is made by the petitioners seeking extension of time, such representation is required to be considered, keeping in mind the various factors. The respondents cannot sit over the representation of the petitioners in light of the deadline fixed in the extension order for joining of the petitioners. Therefore, this Court is inclined to dispose of the writ petition.
5. As a result, the writ petition is disposed of directing the respondent No. 3 – The Director (Public Health), Medical And Health Services, Government Of Rajasthan, Jaipur Rajasthan to consider the representation of the petitioners dated 16.01.2026. Such consideration shall be done by 06.02.2026 and the respondent No. 3 shall keep in mind that the deadline for joining on the post of Medical Officer is 11.02.2026, therefore, the consideration of the petitioners’ representation shall not be delayed. If the consideration is delayed, the petitioners are given liberty to make appropriate application in this regard.
6. All pending applications, if any, stand disposed of.
