1. These bail applications have been filed under Section 483 of
BNSS, 2023 on behalf of accused-petitioners in connection with
FIR No.11/2024 registered at Special Police Station (SOG) Jaipur,

District ATS & SOG for the offences under Sections 419, 420, 467,
468, 471 & 120-B IPC and Sections 3, 4 & 6 of the Rajasthan
Public Examination (Prevention of Unfairmeans) Act, 1992.
2. Heard.
3. Considered the submissions made by counsel for the
petitioners as well as learned Public Prosecutor and also perused
the material made available on record.
4. First bail application bearing S.B. Criminal Misc. Bail
Application No.4702/2024 of the accused-petitioner-Roshan Lal
Meena was dismissed vide order dated 05.09.2024 with liberty to
file fresh bail application after passes the order regarding framing
of charges by the learned trial Court.
5. The allegation against the accused-petitioner-Roshan Lal
Meena is that he appeared as a dummy candidate in place of
Dinesh Meena in the Junior Assistant examination of 2018.
6. The allegation against the accused-petitioner-Mahesh Kumar
Meena is that he was part of conspiracy in arranging Roshan Lal
Meena to appear as dummy candidate in place of Dinesh Meena.
7. Both the accused-petitioners are in custody since 02.04.2024
and 19.08.2025 respectively.
8. The learned trial Court vide its order dated 07.01.2025 has
framed the charge against the accused-petitioner-Roshan Lal
Meena for offences under Sections 419, 420, 467, 468, 471 &
120-B IPC and Sections 3, 4 & 6 of the Rajasthan Public
Examination (Prevention of Unfairmeans) Act, 1992.
9. It is submitted by counsel for accused-petitioner-Roshan Lal
Meena that the offences for which the charges have been framed

against him are triable by the Court of Magistrate. She further
submits that the charges have been framed against the accused-
petitioner on 07.01.2025 and even after passing of more than a
year, the trial of the case has not been concluded. She also
submits that as per Section 480(6) of BNSS, 2023 for the offences
which are triable by the Court of Magistrate trial if, the trial is not
concluded within a period of 60 days from the first date fixed for
taking evidence, in that situation the accused become entitle for
bail.
10. Learned counsel appearing for the accused-petitioner-
Mahesh Kumar Meena submits that the accused-petitioner is in
custody since 19.08.2025 and the charges have been framed
against him on 12.01.2026. He also submits that the only
allegation against the accused is of, he was said to be a part of
conspiracy for arranging dummy candidate in place of Dinesh
Meena and the only evidence available with the prosecution is that
he went alongwith Dinesh Meena at the place of exam
