1. These applications for bail under Section 483 BNSS have been filed by the petitioners who have been arrested in connection with F.I.R. No.375/2025 registered at Police Station Anupgarh, District Sri Ganganagar, for the offences punishable under Sections 115(2), 331(6), 103(1), 191(2), 191(3), 190, 61(2) of BNS and Sections

3(2)(va) and 3(2)(v) of SC/ST Act.

2. Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioners submitted that, as per the prosecution case, on 29.06.2025 at about 08:00 p.m., Bittu Singh, Jassa Singh, Ravi, Gauri and Jagseer, along with five to six other persons, unauthorizedly entered the house of the complainant and, in a pre-planned manner, assaulted the deceased Mukesh with blunt weapons. It was further alleged that when the complainant and her family members attempted to intervene, they were also assaulted by the assailants.

4. Learned counsel contended that the petitioners have not been named in the FIR. As per the post-mortem report, the cause of death of the deceased was hemorrhagic shock due to head injury. The lathi allegedly used in the commission of the offence, bearing blood stains, has been recovered at the instance of co- accused Jagseer Singh. Other blunt weapons have also been recovered from co-accused Prem Kumar, Jasprit Singh @ Jassi and Bittu Singh. No blunt or sharp weapon has been recovered from the present petitioners. Further, neither the FIR nor the statements of the eye-witnesses attribute any overt act to the petitioners.

5. Lastly, learned counsel submitted that the petitioners are in judicial custody; the investigation against them has already been concluded; and the trial is likely to take a considerable time to conclude. Therefore, it was prayed that the petitioners be enlarged on bail.

6. Per contra, learned Public Prosecutor vehemently opposed the bail applications.

Having considered the rival submissions and the facts and circumstances of the case, this Court prima facie finds that the petitioners have not been named in the FIR; no material indicating motive on the part of the petitioners to commit the alleged offence is available on record; the weapons allegedly used in the commission of the crime have been recovered at the instance of co-accused persons; no test identification parade was conducted by the police to establish the presence of the petitioners at the place of occurrence; the investigation against the petitioners has already been concluded; and the learned Public Prosecutor has not expressed any apprehension regarding the petitioners influencing the witnesses or absconding in the event they are enlarged on bail. Thus, without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the bail applications filed by the petitioners deserve to be accepted.

8. Consequently, these bail applications under Section 483 BNSS are allowed. It is ordered that the accused-petitioners (1) Ajay Singh S/o Baljinder Singh and (2) Ranjeet Alias Jeetu S/o Palaram arrested in connection with the FIR No.375/2025, registe
